Archived web pages are not hearsay

A 'web page archive' is a page that is no longer an active page on the web but which has been archived by a search engine. Google does this and there is a site whose sole function is to archive web pages.

In Telewizja Polska USA, Inc. v. Echostar Satellite Corp., 2004 WL 2367740 (N.D.Ill. Oct. 15, 2004) a federal judge held that the 'snapshot' in the archives of what the web page looked like at some time in the past were (1) not statements at all and thus were not statements and, (2) if considered as statements were admissions against interest. Authentication was satisfied through an affidavit from the Internet Archive Company.
